Terms and Conditions

Thank you for choosing our dance company. You will find our terms and conditions below, which apply to in-person classes, online/video courses, workshops, and events.

 

CLASS payments & Refunds

Class fees must be paid in full before the start of the term or class. Your place in the class/term is not confirmed until payment has been received.

The course package applies to the dates and class length specified in the product details.

All classes/memberships are automatically renewed monthly depending on the selected class membership package. For example, if it is a six-month class membership package, you will be responsible for making six monthly payments, with the first payment being made at the time of purchase. The remaining payments will be taken automatically on the 1st of each month.

The class membership purchased will give you access to one dance class per week, totalling four classes per month for the period stated in the class product plan. If there are five weeks in a month, the instructor may use that week as a holiday week.

All classes are non-refundable. Refunds cannot be given if:

  • you change your mind;

  • for online classes, you do not have the appropriate technology or resources to attend;

  • you are unable to attend class for any reason outside of our control.

However, you can make up a missed class by attending another group class of the same level at any of our studios, within four weeks of the missed class.

No make-up classes or refunds are given where classes clash with public holidays.

If an instructor is ill, injured, or unable to teach for any reason, the instructor may cancel the class or have a substitute teacher teach it. If your class is cancelled by the instructor, the instructor will make arrangements to make up the class to you or provide you with the opportunity to book a different class session. We reserve the right to use substitute teachers of similar calibre in the case of unavoidable illness or injury and may vary advertised class programs should the need arise.

All classes are subject to a minimum number of students. If enrolments do not meet the minimum, the class will be cancelled. If your class is cancelled for this reason, you will be entitled to a full refund, or the opportunity to book into a different class session.

 

CLASS CANCELLATIONS

If you choose to cancel your class membership package, please provide us with written notice of cancellation at least 30 days before the next payment due date. To initiate the cancellation process, please contact Natalie at natalie@dancingdivinity.com.

 

Health & Safety

For most people, dancing is a fun and safe form of exercise. However, all physical activity may carry health risks. Dancing Divinity does not take any responsibility for your health and fitness, especially when you undertake a remote class. Dancing Divinity cannot and will not provide medical advice. Your health and fitness are your responsibility.

The following precautions are recommended to help provide you with a safe environment:

• Dancing Divinity strongly encourages participation in the warm-up and cool-down of each class;
• Bring a water bottle and ensure you are well hydrated;
• If you have a pre-existing injury, or medical condition, or are pregnant, seek professional medical advice before attending class. Please also advise Dancing Divinity of your condition and the medical advice you have received. Dancing Divinity reserves the right to decline your attendance at class if there are medical concerns.
• Listen to your body – do not move outside your normal range, and take new movements carefully. If you feel pain, stop the movement and notify your instructor.

When booking with us, you, the client accept and assume all responsibility for any loss, damage, injury, or adverse consequence suffered by the client as a result of engaging in dance and indemnify Dancing Divinity Dance Company, Natalie Clark, and the Dancing Divinity Instructors absolutely in respect to any claim by or through the client in the event of injury to or the demise of the client as a consequence of engaging in dance. The client acknowledges that some physical contact may be necessary for the course instructor, and photos/videos may be taken during the class or event.

COVID-19 or other public health Disruptions: Dancing Divinity reserves the right to cancel, change or alter classes (including to an online format) in accordance with Public Health guidance and rules. If classes change to an online format, and you are unable to access the technology, you may be entitled to a pro-rata refund for any remaining classes.

 

General Terms & Conditions

Class Admission: Dancing Divinity reserves the right to decline your attendance at class if your teacher considers that your attendance is disruptive to the safe environment of the class. 

Class Photos & Videos: Classes may be recorded by way of photograph or video for learning or promotional purposes. For more information, see the Privacy Policy.

Participation in performances: Students of Dancing Divinity may be invited to perform belly dance (for example at community cultural events and the Dancing Divinity end-of-year show). Student participation in these events is unpaid and voluntary. If students wish to participate, they will be expected to attend all practices and rehearsals. They may also be required to purchase or make costumes, assist with the sale of tickets, and appear in promotional material. If a student cannot commit to the requirements of performing, they should not perform.

 

ONLINE CLASSES

 

In any online (live-streaming) classes, it is your responsibility to ensure that you have a suitable device, internet connection, and safe dance space to participate in classes.

Classes are live-streamed and must be attended at the appointed time. Dancing Divinity may record online classes. For more information, see the Privacy Policy.

You will not share class login information or record or distribute content to others who are not enrolled in the class.

You will set up your camera and lighting so that your body is visible to the instructor. If you do not use a camera, we cannot give you feedback.

 

WORKSHOPS & EVENTS

 

Availability: Bookings are subject to availability, Space is limited.

Punctuality: Workshops will begin at the stated time in the workshop program. You will need to sign in, so please ensure that you arrive at least 15 minutes before the workshop. Should the workshops be delayed due to unforeseen circumstances, Dancing Divinity Dance Company, the Workshop Instructors and/or organization/s who own the venue/s at which the workshop will be held. will not be held liable.

Discounted Packages: Please note that discounted package options are per person and cannot be shared amongst individuals.

Methods of Payments: The only acceptable methods of payment will be via PayFast or Direct EFT. Credit Card Payments, physical Cash and Cheques will not be accepted. Payments not made in time will result in non-admission to the workshop until the outstanding fees are paid in full. Preference will be given to those who have paid in full.

Cancellations: If we cancel a workshop, booking fees will be refunded or an alternative workshop may be offered (at our discretion). If you cancel, we regret that NO REFUNDS can be made. You are welcome to send a replacement dancer in your place should you not be able to attend on condition that you inform Natalie Clark with the details of the replacement. No replacement certificate will be offered. In the unlikely event that you are unhappy with your first workshop, you may not cancel the remainder workshops that you have booked for.

Workshop Refunds: Unless we cancel the workshop, there is no refund for workshops. You can sell and transfer your registration to another student, and if we have a waiting list, we are glad to help you find a purchaser.

Show ticket Refunds: Unless we cancel the show, there is no refund for tickets. You can sell and transfer your registration to another student, and if we have a waiting list, we are glad to help you find a purchaser.

Video Cameras: You will NOT be permitted to bring video cameras or other recording devices into the workshops. You are welcome to take photos with Workshop Instructors and/or anybody else AFTER the workshop has finished, only if the Workshop Instructors approve or allow it. Should you film the workshop in any way, you will be asked to leave.

Merchandise: All merchandise sold at the workshops is non-refundable and there are no exchanges or refunds.

Disclaimer: We reserve the right to use substitute teachers of similar calibre in the case of unavoidable illness or injury and may vary advertised workshop programs should the need arise.

Indemnity: Please take note that, should any injury, death, accident, loss, theft, delays, damage or any irregularity of whatever nature occur, no claim may be lodged against Dancing Divinity Dance Company, the workshop instructors and/or anybody involved in the workshops nor against the person/s and/or organization/s who own the venue/s at which the workshop will be held.

Issues: Dancing Divinity Dance Company, the Workshop Instructors and/or organization/s who own the venue/s at which the workshop will be held will not be responsible for issues arising at the workshops relating to venue / workshops or the behaviour of other dancers. Dancing Divinity Dance Company will not be held liable for any issues students may have with what is taught by the Workshop Instructors.

Liability: Dancing Divinity Dance Company, the Workshop Instructors and/or organization/s who own the venue/s at which the workshop will be held. do not accept any liability of whatever nature for the acts, omissions, or default, whether negligent or otherwise, of companies / persons providing services in connection with your booking pursuant to a contract between them and yourselves and over whom we have no direct and exclusive control. We do not accept liability in contract or in tort (actionable wrong) of any injury, damage, loss,  delay, additional expenses or inconvenience caused directly or indirectly by force majeure or other events which are beyond our control  or which are not preventable by reasonable diligence on our part including but not limited to war, civil disturbance, dire, floods,  unusually severe weather, acts of God, acts of Government, acts of nature or of any other authorities’ accidents.
